Children's Internet Protection Act (CIPA) Policy

 

FCC Compliance Regulations "FCC 01-120" state:

In order to receive discounts for Internet access and internal connections services under the universal service support mechanism, school and library authorities must certify that they are enforcing a policy of Internet safety that includes measures to block or filter Internet access for both minors and adults to certain visual depictions. These include visual depictions that are (1) obscene, or (2) child pornography, or, with respect to use of computers with Internet access by minors, (3) harmful to minors. An authorized person may disable the blocking or filtering measure during any use by an adult to enable access for bona fide research or other lawful purpose.

In order to receive discounts, school and library authorities must also certify that they have adopted and implemented an Internet safety policy addressing (i) access by minors to inappropriate matter on the Internet and World Wide Web; (ii) the safety and security of minors when using electronic mail, chat rooms, and other forms of direct electronic communications; (iii) unauthorized access, including so-called "hacking," and other unlawful activities by minors online; (iv) unauthorized disclosure, use, and dissemination of personal information regarding minors; and (v) measures designed to restrict minors' access to materials harmful to minors.

This policy shall be consistent with federal and state constitutional, legislative provisions and regulations, the Tulare County Library Public Internet Use Policy, and with the Tulare County Library Public Internet Guidelines. The aforementioned polices must be used in conjunction with this policy for a complete understanding of Internet Policy of the Tulare County Library System.

To the extent possible and using appropriate technologies, the Library will provide access to information on the Internet, but will block the display for users who are minors, visual depictions harmful to minors and, for all users, visual depictions that are obscene or child pornography. Within these provisions and policy, access to information through the Internet for minors shall be the responsibility of the parents.

The library's goal is to provide children Internet access in a safe environment. Children will be directed to appropriate information for their informational needs. Children will be educated on the safe use of electronic mail, and other forms of direct electronic communication. To the extent possible they will be barred from unauthorized access, and their privileges suspended if an unauthorized use is detected. Parents and children will be educated on the proper disclosure and use of personal information when using the Internet.

 

Implementation by County Librarian

1. The Library will continue to use its policy on library behaviors to support the Library as a safe place for children.2. The Library will develop brochures and other information in both print and electronic form to communicate this policy to the community.3. The Library will work with the other members of the San Joaquin Valley Library System to acquire software and hardware to support filtering as required by the Policy and all laws as passed by the US Congress and the California Sate Legislature.4. Once this new policy is in place, the current methods/software tools will be extended to adults.5. Public Training will be scheduled with the subject matter to consist of safety and Internet usage, including the limitations of filtering software; and the parent's role as a guide for their children. Sessions will be scheduled with the audiences of adults and children both together and separately.6. Staff will begin now developing information to interpret the changes coming so those current users will be on notice about the change.This policy will become void if and when the federal courts ruling that CIPA regulations are unconstitutional is verified by the Supreme Court by either their ruling or failure to hear the appeal.
